This page (together with the documents referred to on it) advises you of the terms and conditions on which we supply any of the goods or services referred to on our website (http://www.oakeco.co.uk/ (our site)) and any other URL directed to the domain, to you our Customer. Please read these terms and conditions carefully before ordering any goods from our site. You should understand that by ordering any of our goods, you agree to be bound by these terms and conditions.
Please check the box marked “I accept the terms and conditions” on the Checkout page before pressing “Continue”. Please understand that if you refuse to be bound by these terms and conditions, you will not be able to order any goods from our site.
Please print a copy of these terms and conditions for future reference.
‘Customer’ refers to the individual, person, firm or company purchasing products as described on the invoice and or website.
‘Oakeco’ refers to Oakeco and BRAMF Ltd and parties either sub contracted or in the employment of BRAMF Ltd.
‘Product’ refers to any item purchased directly or indirectly from BRAMF Ltd or any of it’s subsidiaries.
‘Contract’ refers to the document or documents specifying the price, description of the product and the terms and conditions agreed by the customer. Please also refer to ‘How the Contract is formed’
‘Agent’ refers to any person or persons acting on behalf of or working for the ‘Customer’ in whatever capacity relating to the purchase or installation of goods or services.
1. Who are Oakeco?
http://www.oakeco.co.uk/ is a site operated by BRAMF Limited trading as oakeco.co.uk (we). We are registered in England and Wales under company number 06987969 and our registered office is at 13-14 High Street, Fareham, Hampshire, PO16 7AF.
2. Eligibility to Purchase Product
2.1 All products on the website are available for sale to Customers who are residents of mainland United Kingdom only. We do not accept orders from or deliver products to individuals outside of this territory. We can however arrange delivery outside of this territory. Please contact us for details.
2.2 In order to satisfy certain legal requirements and ensure that the delivery of the products can be made effectively and safely we need to be sure of certain pieces of information about you.
2.3 By placing an order through our site, you the Customer confirm and acknowledge that:
(a) You are legally capable of entering into binding contracts; and
(b) You are at least 18 years old;
(c) You are resident in the United Kingdom; and
(d) You are accessing our site from that country.
3 Pricing, Purchase, and Payments
3.1 All prices are quoted in UK Pounds Sterling inclusive of VAT at the prevailing rate and goods are sold under English law. Delivery of some goods are free (subject to product and destination, please see our Delivery page and individual products for details).
3.2 The price of any products will be as quoted on our site from time to time and included on your Order Confirmation, except in cases of obvious error.
3.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation.
3.4 Our site contains a large number of products and it is always possible that, despite our best efforts, some of the Goods listed on our site may be incorrectly priced. We will normally verify prices as part of our order confirmation procedures so that, where a product’s correct price is less than our stated price we will charge the lower amount when dispatching the Goods to you. If a product’s correct price is higher than the price stated on our site, we will at our discretion, either contact you for instructions before dispatching the Goods, or reject your order and notify you of such rejection.
3.5 All products must be paid for in full prior to dispatch. Reservation of title: Notwithstanding delivery of the Products to the Customer ownership of the products (both legal and equitable) will not pass to the customer but will remain vested in the Seller (Oakeco) until such time as full payment has been received by the seller (Oakeco) in the form of cleared funds and received into the Oakeco bank account.
3.6 Payment for all Goods can be by credit or debit card, telegraphic transfer, or cheque. We accept payment with Visa, Delta, Switch, Solo. Where payment is made by way of credit or debit card, we will take payment from the relevant account at the point of order. We will not dispatch your order until we have received payment in full.
3.7 Where a refund has been agreed and confirmed Oakeco will make payment of said refund within 21 working days of such agreement.
3.8 Outstanding payment: If any payment is late or outstanding Oakeco reserve the right to make charges in accordance with The Late Payment of Commercial Charges Debts Act of 2002.
4 Delivery & Returns
4.1 Delivery of most goods are free (subject to product and destination, please see our Delivery page for details).
4.2 Oakeco outsources it’s delivery service. All goods are shipped by a professional distribution company. Oakeco continually strives to ensure that their delivery service is of the highest standard and appropriate for the products being supplied and as such may from time to time change, alter or replace their service provider.
4.3 Unless otherwise stated please allow 21 days for delivery. All dates for delivery are estimates only. Please ensure that all delivery details are accurate as incorrect details could lead to a delay in delivery. Whilst we make every effort to deliver goods within the estimated timescales, on occasion delays are unavoidable due to unforeseen factors. Contact and delivery lead-times supplied by the delivery provider should not be relied upon for the purposes of engaging and Agent as Oakeco accepts no liability whatsoever for any costs that may be incurred by relying on such information.
4.4 We shall be under no liability for any delay or failure to deliver the goods within the estimated timescale. We recommend that you only make arrangements for Agents to carry out any required work on your behalf only after you have received the goods.
4.5 A signature will be required on receipt. All goods must be signed for by a person over the age of 18. Products should be checked at time of delivery. Oakeco pride themselves in ensuring that all products dispatched are in accordance with the order and in perfect condition. It is imperative that products are checked upon delivery and no claims can be made once any alterations have been made to a product. Any loss or damage to the goods caused after delivery will be your responsibility. If you require any assistance or guidance on the best way to inspect any item, please contact us.
4.6 In the unlikely event that any fault or damage is identified at the time of delivery the word ‘Damaged’ must be written on the delivery note and countersigned by the delivery driver. ALL packaging and associated delivery material must be retained and not removed until the matter has been resolved.
4.7 Any item returned for whatever reason other than those described in 4.6 will be subject to a 20% restocking charge along with any return delivery charges.
4.8 Claused signatures. No liability whatsoever will be taken by Oakeco or our chosen delivery service provider when a signed POD (Proof Of Delivery) note has been obtained and the words ‘not checked’, ‘unexamined’ (or words to same or similar effect) for shortages or damages subsequently identified.
4.9 If we are unable to make a delivery because delivery is refused or missed at the delivery address you may incur a re-delivery charge, as we have fulfilled our obligations to you. Please ensure that every effort is made to accept delivery on the agreed date.
4.91 Delivery lead times are quoted from Order Confirmation date. You will be contacted by our delivery service provider who will schedule the delivery directly with you.
4.92 Oakeco reserves the right to decline the return of any product that has been delivered in accordance with the Customers order.
4.93 Products supplied by Oakeco are done so to individual customer requirements based on the information provided at the time of order. This information will be confirmed via the Order Confirmation. Please note that no statutory cancellation rights apply to products that have been specifically made to individual customer requirements. Information relating to your statutory rights can be obtained from your local Citizen’s Advice Bureau or Trading Standards Department.
4.94 Order cancellation: If an order cancellation is required after order confirmation has taken place and prior to delivery, Oakeco reserve the right to charge a restocking fee of 15%. This will be deducted from the refund which will be processed within 21 working days from confirmation of cancellation.
4.95 Customers who live in the United Kingdom have a right to return any standard stock item.
4.96 Fraud: In order to protect against fraud we are only able to ship items to the billing address. We do check the address you give on your order before shipment.
5 Product Enquiries
5.1 We make every effort to offer only products, sizes and colours that are available and in stock with our suppliers. If a size or colour, or type of product is not available, we will notify you on receipt of your order and will reimburse your payment if you chose to cancel the order.
5.2 Any products made to measure from information / measurements provided by the customer are non-returnable.
HOW THE CONTRACT IS FORMED
5.3 Your order constitutes an offer to us to buy a product(s). All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the products have been requested (the Order Confirmation). The contract between us (Contract) will only be formed when we send you the Order Confirmation. If you do not receive the Order Confirmation within 7 days please contact us to ensure that your order has been received.
5.4 The Contract will relate only to those products whose dispatch we have confirmed in the Order Confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Order Confirmation.
6 Product Information
6.1 Oakeco will endeavour to ensure that all specifications, descriptions and supporting information is accurate and is expressly designed to support the Customer in making their purchase. The customer should satisfy themselves that all such information is accurate and appropriate for the purposes of making their purchase and prior to engaging any work through any Agent.
6.2 Building Regulations: Most of the products supplied by Oakeco meet current Building Regulation requirements unless otherwise specified in relation to Document ‘L’ where appropriate. It is however the Customer’s responsibility to ensure that any product purchased meet the requirements relevant to the specific installation as Oakeco accepts no responsibility for failure in such regard. Oakeco recommends that Customers or their Agent contact their local planning officer for advice.
6.3 Where products are described as Oak, Dark Hardwood, Light Hardwood and or other timber types, this refers to the veneers, lippings and other components used to manufacture the products. Products supplied by Oakeco are manufactured using modern techniques and are generally of an engineered construction. This method of construction delivers a more stable and sustainable product in the opinion of Oakeco.
6.4 The use of the word ‘solid’ in any description does not infer that any such product is made of out of a single piece of wood. See 6.3 for methods of construction.
6.5 All images on the Oakeco website are used to represent the style of products only. The colours of these images should not be relied upon as a true reflection of the product colour. The finishing and decoration of all products will ultimately dictate the look of the final finished product. All doors are supplied in a natural and unfinished state unless otherwise stated. Timber is a natural product and as such is liable to varying colours and tones. Our manufacturers and suppliers do endeavour to colour match components within individual products but due to the nature of wood no guarantee whatsoever is given that one product will be a colour match for any other product.
6.6 Oakeco continually strives to ensure that all products supplied to it’s customers are of the highest quality and as such reserve the right to update designs, styles and to add or remove and amend descriptions, specifications and methods of construction described on the website at any time.
7 Product Care and Storage
7.1 Storage of goods post delivery and prior to installation: All products supplied by Oakeco have been sourced and manufactured to the highest standards. The ongoing care of all products must be maintained post delivery and prior to final finishing and installation to ensure the product remains in perfect condition. Products must be stored in a cool dry atmosphere and kept flat. Products must not be exposed or kept in a damp environment or exposed to central heating or any other form of direct heat.
7.2 Treatment and decoration: All treatment and decoration must be carried out in accordance with the recommended instructions. This is vital to maintain the condition of the product and sustain it for many years to come. All doors must be treated and sealed immediately after unpacking and prior to installation and hanging. Any edges and cut outs etc, for handles hinges, locks, and letter plates must have specific attention prior to installation to prevent any moisture ingress that could adversely impact the product. Failure to comply with the treatment and decorating instructions will invalidate any Warranty or Guarantee offered.
8. Warranties & Guarantees
8.1 Products supplied by Oakeco are manufactured to the highest standards using the latest and most modern methods of construction. Products supplied by Oakeco are guaranteed to be free from manufacturing defects for a period of twelve months from the date of order. On occasion our manufacturers offer extended warranties of up to 10 years. Where these warranties are available Oakeco will be happy to provide information and contact details for these manufacturers for the purposes of Warranty provision.
9. Our right to vary these terms and conditions
9.1 These terms of sale and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
9.2 We have the right to revise and amend these terms of sale from time to time, for example to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.
9.3 You will be subject to the policies and terms of sale in force at the time that you order goods from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Order Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the goods).
10.1 If the courts decide that any part or wording in these terms of sale is illegal, invalid or unenforceable then that part or wording shall be deleted from the agreement and the rest of the terms of sale shall remain in force.
10.2 All contracts formed, sales made and legal disputes arising through the use of this website shall be governed by English law. The English courts shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms of sale or use of our site.
10.3 These terms and conditions shall apply to all internet sales made by Oakeco and by placing an order with us you are accepting these terms and conditions.
10.4 No waiver of any right or remedy or variation of the terms of this Contact will be effective unless given and agreed in writing.
